These Terms of Service ("Terms") govern your use of garden.thyme.farm and any purchase made through it (the "Site"), operated by Thyme LLC ("we," "us," "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms cover general use of the Site and any purchases made through it. Our free monthly prize drawing is governed separately by our Official Rules, and our data practices by our Privacy Policy. Where these Terms and the Official Rules conflict on a sweepstakes-specific matter, the Official Rules control.
You must be 18 years or older to use this Site or make a purchase. You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to access non-public areas, or submit false or misleading information.
Optional add-on products (currently: a Seed Starter Kit) may be offered for purchase. Prices are stated in US dollars and shown at checkout before you pay. Payment is processed by Stripe; we do not store your full payment card details. Risk of loss and title for any physical item pass to you upon our delivery to the shipping carrier.
All sales are final. We do not offer refunds or accept returns on purchased items, except where required by applicable law. If your order arrives damaged, defective, or was never delivered, contact us at the email below and we will work with you in good faith to resolve it.
All content on this Site — including text, graphics, logos, and design — is owned by us or our licensors and protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute Site content without our prior written permission. "The Garden Raffle" name and logo are our property.
If you submit any content to us (for example, a reply to a poll or newsletter question, or a testimonial), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting the Site, unless we agree otherwise with you in writing. Do not submit content that is unlawful, infringing, or that you do not have the right to share.
The Site and any products offered through it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or any purchase, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed the amount you paid us, if any, in the twelve (12) months before the claim arose.
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts. Nothing here prevents either party from bringing an individual claim in small claims court.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
We may update these Terms from time to time. Changes take effect when posted on this page. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
